As an estate planning and probate attorney, I am often asked questions about the probate process. To help my clients understand probate I have developed a diagram that walks through the steps involved in probate and answers most questions clients have about the process.
Most recently, because of the Coronavirus, the question that I am often asked is how they can go about doing a probate. The reason for this is that in many instances surviving spouses or children are in different areas of the United States and are unable to travel to Idaho.
The good news is that in 2018 Idaho’s courts switched over to the e-filing process. This means that all new cases, including probate cases, can be filed electronically. The result of this is that it makes the process of creating the probate documents, getting the probate documents signed and notarized by everyone, and getting them filed with the court much simpler than ever before.
During the Coronavirus we have assisted many of our clients begin the probate process by filing probate documents with courts in Idaho. We are also able to communicate with many of our clients through telephone or video calls. Additionally, through email correspondence we are able to get documents back and forth to get the signatures, and the notarizing necessary have all the documents needed to begin and complete the probate process.
