FATALITY CRASH IN DELCO INVOLVING TWO VEHICLES

In Cassia County, Idaho two vehicles got into an accident on December 7th, 2024, just outside of Delco. The vehicles were traveling westbound on I 86 at mile post 12 at the time of the accident.

At roughly 2:17 p.m, a 43-year-old woman from Englewood, Colorado driving a red 2003 Subaru Legacy, was traveling westbound when she collided with another car. The other vehicle, a 2018 Buick Enclave, was also traveling westbound driven by a juvenile from Boise, Idaho. When the vehicles collided, they were both sent off the roadway, before rolling and landing in a ditch.

The driver of the legacy sustained major injuries and passed at the scene. She was not wearing a seat belt at the time of the accident. The driver of the Buick was wearing a seat belt and sustained no major injuries. His injuries were treated on the scene and he was not taken to a hospital.

We are sorry to hear about this accident and we send our condolences to the friends and family of the woman who passed.

Unfortunately, according to Idaho Transportation Department’s crash report in 2023, multiple vehicle crashes accounted for 72% of all motor vehicle crashes in 2023, leaving a total of 19,807 multi-vehicle crashes. Of that total, 151 of those crashes resulted in fatality, and 594 caused serious injury.

LIABILTIY FOR ACCIDENTS IN IDAHO

No one who gets into or drives a vehicle wants to be involved in an accident. But unfortunately, car accidents happen. Idaho uses a fault-based system to impose liability on the party most at-fault for the accident. A legal principle called “comparative negligence,”  is applied to determine the negligence of all involved parties. If the Plaintiff’s negligence is less than 50%, then she generally can recover damages from the Defendant (or the Defendant’s insurance policy).

Our personal injury attorneys can advise injured persons about their particular case and how Idaho’s legal principles of negligence, causation, and liability apply to it.
