SINGLE VEHICLE ACCIDENT AFTER DRIVER HITS AN ELK CARCASS

On March 30th in Fort Hall, a single vehicle driven by a 62-year-old man from Rigby ran into an elk carcass that had not been removed from the roadway. The accident took place on Interstate 15, at mile marker 84, in Bingham County.

The driver, traveling in a 2004 Toyota Tacoma, was headed southbound on I15. At approximately 6:00 a.m., he came upon the elk and was unable to avoid it in time. He collided with it, causing him to lose control of the vehicle. He left the roadway, entered the median, and hit the vehicle crossover which caused the vehicle to overturn.

Following the accident, the driver was transported to a local hospital by ground ambulance. Reports include that he was not wearing a seat belt at the time of the accident.

We are sorry to hear about this accident and we hope that this man will be able to make a full and speedy recovery.

According to the Idaho Department of Transportation’s crash report, 27,679 total motor vehicle crashes occurred in 2023. Idaho’s Traffic Crash Clock indicates that, “A traffic crash occurred every 19 minutes.”

LIABILITY FOR SINGLE-VEHICLE CAR ACCIDENTS IN IDAHO

Although some car accidents may just be an accident, even single vehicle crashes may be caused by the negligence of a different person or entity than the driver involved in the accident. Idaho personal injury and wrongful death law compares the negligence of all persons and entities (including the plaintiff) who were a “substantial factor” in causing the accident. If the injured party’s negligence is less than 50% of the total negligence from other persons or entities, he may be entitled to damages.

Our personal injury attorneys can advise injured persons about their particular case and how Idaho’s legal principles of negligence, causation, and liability apply to it.
