Sunday afternoon at 5:42 p.m. on October 27th, two young men were riding their motorcycles on East County Road in Power County.
The riders, who were traveling eastbound, were both young men from Pocatello. One was a 25-year-old man driving a 2007 Honda motorcycle, and the other, a 26-year-old man driving a 2007 Yamaha motorcycle. They unfortunately collided when they unsuccessfully navigated a curve. The crash caused both to slide into a nearby concrete barrier. During the crash, both drivers were separated from their vehicles. Both the bikes and both individuals came to rest on the right shoulder of the road.
At the time of the accident, both men were wearing helmets. However, the 25-year-old sustained major injuries and passed at the scene. The other individual, the 26-year-old man, sustained minor injuries that did not require him to be transported to a hospital, but were treated by EMS at the scene.
This accident is under continued investigation by ISP. The identities of the two individuals have not yet been disclosed.
We send our deepest condolences to the loved ones of the young man that passed in the accident. We also send our condolences to the other young man who was injured and lost his friend, and hope that he is able to fully recover.
LIABILTIY FOR ACCIDENTS IN IDAHO
No one who gets into or drives a vehicle wants to be involved in an accident. But unfortunately, accidents happen. Idaho uses a fault-based system to impose liability on the party most at-fault for the accident. A legal principle called “comparative negligence,” is applied to determine the negligence of all involved parties. If the Plaintiff’s negligence is less than 50%, then she generally can recover damages from the Defendant (or the Defendant’s insurance policy).
